General Terms and Conditions of Sale (T&Cs)

These general terms and conditions of sale (referred to as « T&Cs ») apply, without restriction or reservation, to all sales concluded by the Seller to non-professional buyers (« The Customers or the Customer »), wishing to acquire the products offered for sale by the Seller on the website https://www.caricature.fr

Article 1 – Purpose
These T&Cs aim to define the contractual relationship between Sébastien Rieu and the Customer, and the conditions applicable to any purchase made through the website https://www.caricature.fr
. The acquisition of a product through this site implies unreserved acceptance by the Customer of these conditions of sale, which the Customer acknowledges having read prior to placing an order.
Article 2 – Products
The products governed by these T&Cs are those listed on the website https://www.caricature.fr
. They are original and personalized artistic creations, including caricatures, portraits, paintings, and other graphic works, made to order from photographs provided by the Customer.
Article 3 – Pricing
The prices listed on the product sheets of the online catalog are in Euros (€) All Taxes Included (TTC). As Sébastien Rieu operates under the sole proprietorship regime, VAT is not applicable, in accordance with Article 293 B of the French General Tax Code.
The Seller reserves the right to change its prices at any time, but the product will be billed based on the rate in effect at the time the order is confirmed.
Article 4 – Orders and Payment Terms
Before placing any order, the Customer must create an account on the website https://www.caricature.fr
or provide the necessary information for the transaction.
The ordering process is as follows:
- The Customer selects the desired product or service.
- The Customer provides the necessary elements for personalization (photographs, specific instructions).
- The Customer confirms the order after reviewing it.
- The Customer makes the payment according to the provided terms.
Payment is due immediately upon ordering. The Customer can make the payment using the methods offered on the site (e.g., credit card, PayPal). Confirmation of an order implies acceptance of these terms of sale.
Article 5 – Delivery
Delivery is made to the address indicated by the Customer when ordering. Delivery times are provided as an indication and correspond to the creation and shipping times. Sébastien Rieu cannot be held responsible for consequences due to a shipping delay that is not his fault.
Article 6 – Right of Withdrawal – Exception for Custom Goods
In accordance with the provisions of Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to « the supply of goods made to the consumer’s specifications or clearly personalized. »
All works offered on the site https://www.caricature.fr
(caricatures, portraits, paintings, etc.) are considered clearly personalized goods, as they are created based on the Customer’s photographs and specific instructions.
Consequently, the Customer is informed that no right of withdrawal can be exercised once the order has been confirmed and paid for. Each sale is firm and final.
Article 7 – Intellectual Property
All elements of the site https://www.caricature.fr
are and remain the exclusive intellectual property of Sébastien Rieu. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site, whether in the form of a photo, logo, visual, or text.
Sébastien Rieu remains the copyright holder of his creations. The purchase of a work does not entail the transfer of reproduction or representation rights.
Article 8 – Personal Data
Personal data collected from Customers is intended for processing orders and issuing invoices. In accordance with the « Informatique et Libertés » law no. 78-17 of January 16, 1978, you have the right to access, modify, rectify, and delete data concerning you.
Article 9 – Applicable Law and Disputes
These T&Cs are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing that, only the French courts will be competent.
